Terms of Service

1. Acceptance of terms

By creating an account or using the Arcavia platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use Arcavia. These Terms apply to all users, including Free and Pro subscribers.

2. Your account

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account.
• You may not share your account with others or create multiple accounts to circumvent plan limits.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Your content

You own everything you write in Arcavia. By storing your content on our platform, you grant Arcavia a limited, non-exclusive, non-transferable licence to store and display your content solely for the purpose of providing the Service to you. We will never:

• Claim ownership of your writing
• Use your stories to train AI models
• Share your content with third parties without your consent
• Display your private stories publicly

You are responsible for ensuring your content does not infringe third-party intellectual property rights. Arcavia is not liable for the content of user stories.

4. Prohibited use

You agree not to use Arcavia to:

• Upload or distribute illegal content
• Harass, threaten, or harm other users
• Attempt to gain unauthorised access to other accounts or our systems
• Reverse-engineer, scrape, or reproduce the Service
• Use automated tools to access the Service in a manner that overloads our infrastructure
• Circumvent payment or subscription limits

5. Free and Pro plans

The Free plan is available indefinitely with the features listed on our Pricing page. Pro plan features and pricing are also listed on the Pricing page and may change with 30 days' notice to existing subscribers.

If you downgrade from Pro to Free, you retain access to your content but will be subject to Free plan limits (e.g. maximum 3 active projects). No data is deleted on downgrade.

6. Payments and refunds

Pro subscriptions are billed monthly or annually via senangPay. All prices are in Malaysian Ringgit (MYR) and inclusive of any applicable taxes.

Subscriptions renew automatically. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period.

We offer a 7-day money-back guarantee for new Pro subscribers. To request a refund, contact us at billing@arcavia.app within 7 days of your first charge.

7. Availability and data

We aim for high availability but do not guarantee uninterrupted service. We are not liable for data loss caused by technical failure, though we maintain regular backups.

We strongly recommend periodically exporting your writing using the in-app export feature (available to Pro users) as an additional backup.

8. Limitation of liability

Arcavia is provided "as is." To the maximum extent permitted by Malaysian law, we exclude all warranties, express or implied. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or loss of revenue.

9. Governing law

These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Kuala Lumpur, Malaysia.

10. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via email and by updating the "Last updated" date at the top of this page. Continued use of Arcavia after changes constitutes acceptance of the updated Terms.
